حقوق اشخاص ثالث در قرارداد رحم جايگزين
Third Party Rights in Surrogate Mother Contracts
توافق زوج قانونی نابارور برای بهرهمندی از رحم زن دیگر جهت حمل و پرورش جنین متعلق به آنها و در نهایت تحویل نوزاد تولد یافته به زن و شوهر مزبور اصولاً در قالب یک قرارداد استدعا و اجابت تحقق مییابد. طرفین عقد در این قرارداد را از یک سو زن و شوهر نابارور و از سوی دیگر مادرپذیرنده جنین «مادر جانشین» تشکیل میدهند و مطابق قواعد عمومی قراردادها اراده انشايی این دو طرف است که منجر به پیدایش عمل حقوقی مورد بحث میگردد. بنابراین مطابق اصل نسبی بودن قراردادها، آثار قرارداد مادر جانشین باید به خود متعاقدین یعنی زن و شوهر متقاضی و مادر حامل محدود گردد.
با آنکه براساس یک قاعده حقوقی پذیرفته شده، درج تعهد به ضرر ثالث در قرارداد منعقده مجاز نیست، اما در عین حال جنبه اجتماعی قرارداد مادر جانشین موجب میشود که اشخاص ثالث دیگری از آثار حقوقی قرارداد ایجاد شده متأثر شوند. این اشخاص متعدد میباشند، برخی از آنها اشخاص حقیقی و یا حقوقیاند که به طور غیرمستقیم از حیث معنوی یا مالی از قرارداد موصوف متضرر میشوند، مثل خویشاوندان مادر جانشین و موسسات بیمهگر این فرد. ولی برخی دیگر مستقیماً و در اثر قرارداد خلق شده بین زوج نابارور و مادر جانشین از دسترسی به حقوق مدنی مسلم خود محروم میگردند، مثل شوهر مادر جانشین و فرزند صغیر او.
خود جنین مورد حمل نیز اگر چه به اعتباری متعلق موضوع قرارداد مادر جانشین و مشخصاً مورد تعهد مادر حامل را تشکیل میدهد، ولی نظر به وصف انسان بودن، نه شیء بودن خویش، در صورت تخطی و تجاوز به حق تکوین و تکامل او از سوی طرفین قرارداد، به عنوان ثالثی جلوه مینماید که امین منصوب و یا مراجع ذیصلاح قانونی در مقام استیفای حق وی برخواهند آمد.
شناسایی و دستهبندی اشخاص ثالث متضرر از قرارداد مادر جانشین و بیان حقوق مورد تعرض آنها و بالاخره بررسی نحوه دخالت این اشخاص در انعقاد قرارداد مذکور حائز اهمیت فراوان بوده و باید در تدوین مقررات مربوط مورد امعان نظر خاص قرار گیرد.
The agreement of the infertile couples to use another woman’s uterus for gestational purposes and nurturing the embryo that belongs to the couples, and finally submitting the newborn to them by the surrogate mother, is based on the contract format of “Ested’ā” and “Ejaabat”_ plea and granting. The parties to this contract are the infertile couples and the surrogate mother who accepts the embryo to nurture. According to the general principles of contracts, the existence and validity of such a contract is due to the intentions bound to the parties. Based on relativity principle of contracts, it is said that consequences of such a contract, will be limited to the parties of the contract (i.e. the surrogate mother and the couples). Contrary to the principle that the obligation against the third party is not valid, some third-party individuals or entities will be affected consequent to such contracts because of social life of the involved parties as human beings. The suffered loss can be economical or moral. The indirectly injured parties can be individuals like relatives of the surrogate mother or entities like her insurer organization. On the other hand, some other individuals would be injured directly due to this contract, and will be deprived from their civil rights. These include the husband of the surrogate mother and her infant baby. The embryo himself which is the subject-matter of the contract, from the point of view that recognizes him or her as a human being and not an object, in case of infringements and breaches of his/ her rights to genesis and completion on behalf of the parties to the contract, is regarded as a third party that appoints individual trustee authorities or other legal bodies to file a suit to protect his/ her rights. Introducing, classifying the injured third party and discussing the type of infringed rights and eventually studying the methods of contribution of the mentioned parties is an important issue that has to be significantly addressed in the codification of relevant Acts.
