بررسی مقایسهای حقوق رحم جانشین در ایران با قانون خاص جانشینی حامل در ایالت ایلینوی آمریکا
Comparing the Iranian Surrogacy Law and the Gestational Surrogacy Act of Illinois
زمینه و هدف: رحم جايگزين یا رحم جانشین یکی از تحولات علمی دهههای اخیر در حيطه درمان ناباروری میباشد و تاکنون اثر و پیامدهای عمیقی در مذهب، حقوق، اخلاق و جامعه به دنبال داشته است. در این میان، وضع قواعد و قوانین خاص حقوقی میتواند بسیاری از چالشها، مشکلات و انحرافات برآمده از عملکرد سلیقهای افراد در این قبیل موضوعات را مرتفع سازد. لذا در این مطالعه سعی شده است، با توجه به تفاوت در منابع حقوقی کشورها، راهکارهایی را که قانونگذار ایرانی هنگام وضع قانون خاص این موضوع باید مدنظر قرار بدهد، پیشنهاد گردد.
روش بررسی: در این مقاله سعی شده است تا ضمن آشنایی با تنها قانون خاص موجود در موضوع جانشینی و چند منبع حقوقی دیگر، مقایسهای اجمالی با حقوق مادر جانشین در ایران صورت گیرد.
نتایج: قانون خاص جانشینی در برخی از کشورها چون هند و استرالیا، تنها در حد پیش نویس اوّلیه است و تاکنون تنها ایالت ایلینوی آمریکا به تصویب قانون خاص مبادرت کرده است. مقایسة این قوانین و مقررات محدود، تفاوتهای ساختاری اندک و شباهتهای بیشماری را بین آنها آشکار میکند. اگرچه این مسئلة نوظهور در ایران نیز هنوز مطابق قانون خاصی نیست؛ ولی در حال حاضر، انجام آن با توجه به جواز شرعی گروهی از فقها و با استعانت از قواعد عمومی حقوق، امکانپذیر است.
نتیجهگیری: به جز مسائل شرعی، عمدة مفاد قوانین و مقررات موجود، پایة عقلانی دارند و براساس نیاز شکل گرفتهاند. لذا میتوان در تدوین قانون خاص جامع و مانع ایرانی نیز، از آنها استفاده کرد.
Background: Gestational surrogacy is a recent revolutionary subject in assisted repro-ductive technology (ART) with profound effects on religious, legal, ethical and societal matters. Since enacting the law in this matter could efficiently handle challenges and prevent subjective inclinations, the authors of this study wished to suggest the adoption of a particular Iranian law on the subject, regarding the different legal systems worldwide.
Methods: In this article, effort has been made to conduct a comparison between the Gestational Surrogacy Law of Illinois, USA and some other similar resources with those of Iranian laws and regulations.
Results: Surrogacy laws in some countries like India and Australia have been drafted but only in the Illinois, USA it has been signed into law. Drawing a crude comparison between the limited existing laws and regulations on surrogacy reveals small structural differences but a bulk of similarities among them. Despite its novelty and regardless of any specific law, surrogacy practices have been made possible in Iran due to the utilization of common rules and observation of Fatwa issued by clerics in this regard.
Conclusion: Aside from religious rules, surrogacy laws meet a rational basis and they have been evolved to address societal needs and seem justifiable enough to be applicable for a general Iranian law preparation.
