آزادي اراده و سلب توانايي باروري
Patient's Autonomy and Infertilization
تمايل به توليدمثل از غرايز طبيعي هر موجود زندهاي است. شوق داشتن فرزند، نزد آدمیان كمال بيشتري يافته است؛ زيرا كه انسان احساس بقاي نسل و تداوم شخصيت بعد از فوت را در اين روش ميبيند. با اين حال، در مواردي توانايي طبيعي فرد جهت باروري به طور موقت و يا دائم سلب ميشود. قطع نظر از مداخلات غيرمستقيم دولتها در اين زمينه كه در راستاي كنترل جمعيت و از طريق اتخاذ تدابير خاص صورت ميپذيرد، در موارد زيادي خود افراد به دلايل پزشكي، رواني، فرهنگي، اقتصادي و يا اجتماعي در مقام تحديد و يا حذف توانايي باروري خويش برميآيند. كاهش و يا نابودي توانايي توليد مثل از روي اراده افراد كه ميتواند در قالب تراضي حقوقي و از طريق انعقاد قرارداد با پزشك و يا احياناً در چارچوب شرط ضمن عقد (مثلاً ضمن نكاح يا قرارداد استخدامي) و يا در محدوده يك قرارداد بي نام بين زوجين انجام پذيرد، اين سئوال را به ذهن متبادر ميسازد كه آيا انسان براساس مقررات موضوعه و موازين فقهي مختار به اسقاط و يا سلب اين توانايي خدادادي از خويشتن ميباشد يا آنكه آزادي در اين زمينه قابل كنترل و نظارت از طريق اعمال قوانين و نظريهها و قواعد حقوقي است؟ بالاخره چگونه ميتوان ميان ضرورت كنترل جمعيت و آزادي فرد در داشتن فرزند را جمع كرد، به طوريكه اساس آزادي انسان صدمه نبيند؟
آنچه مسلم است اينكه هيچكس نميتواند مطابق مقررات قانوني آزادي خود را به طور كلي جهت برخورداري از توان باروري سلب نمايد؛ ولي امكان سلب اين توانايي طبيعي به طور جزئي ممكن است.
با اين حال روشن ساختن و تمايز مفهوم سلب ارادي توانايي باروري به طور كلي و جزئي از يكديگر با ملاك قرار دادن سن و مدت زمان سلب توانايي فوق ضرورت دارد. البته تعيين مرز اين مفهوم هميشه به آساني ممكن نميباشد.
Reproduction is a natural inclination in human beings. Having a child has become more important for human beings, as they see their eternity and survival in child bearing. However, one may temporarily or permanently remove his natural ability to reproduce. Despite the indirect intervention of governments to enforce family planning policies through taking specific measures, there are many cases in which individuals wish to make themselves infertile due to medical, psychological, cultural, economic or social reasons.
Voluntarily reducing or removing fertility potential may be done through various methods. It could be done through a mutually legal consent in a contract with a physician or an unnamed contract between couples or stated as in implied conditions included in marriage or employment contracts. A number of questions may be raised in this regard: Can human beings make themselves infertile and destroy this divine ability, or could this right be regulated? Or how can we integrate autonomy in reproduction and family planning policies?
In fact, no one is legally allowed to completely remove one’s freedom to reproduction. However, a partial / a conditional permission for removal is legally possible. After all, it is necessary to clarify and distinguish between general and partial willful removal of one’s reproduction capability, according to the criteria of age and duration of removal. Finally, the aforesaid clarification and distinctions are not always an easy task to make.
